Treasury Pulls Mixer and Unhosted-Wallet Rules, Calling Them a Chill on Legitimate Use

Fear & Greed73/100Greed ±0 / 7d

What happened. FinCEN formally withdrew two long-contested proposals: a 2020 plan that would have imposed reporting requirements on transactions involving self-custodial wallets, and a 2023 proposal to designate crypto mixing as a primary money laundering concern under the PATRIOT Act. The withdrawals were framed explicitly as part of the Trump administration’s deregulatory agenda.

Why it matters. Both rules had been treated by privacy advocates and self-custody defenders as existential threats to non-custodial infrastructure. Killing them removes a legal cloud that had hung over mixer operators, wallet developers, and anyone building self-sovereign tooling for years. The Fear & Greed Index sits at 73 and flat on the week, suggesting the market had already priced in a friendly regulatory posture rather than treating this as a surprise catalyst.

The catch. Withdrawal is not the same as a statutory prohibition on future rulemaking. A later administration could re-file under the same PATRIOT Act authority with different framing, and the underlying surveillance apparatus remains intact. The spot-market regulatory gap also persists, as the CFTC’s simultaneous proposal this week (see On the Hill) covers leveraged retail trading but leaves unregulated spot venues in a grey zone.

Bitcoin holds near $86K as the dollar reaches an 18-month peak. The DXY hitting levels not seen since early 2025 would ordinarily pressure risk assets, but BTC has so far absorbed the macro headwind without a meaningful breakdown. Traders are pricing out a near-term Fed hike, and technical indicators — including a fresh golden cross on higher timeframes — are being cited as structural support. coindesk decrypt

XRP treasury SPAC surges close to 300% ahead of Evernorth merger. The vehicle jumped on speculation around its planned combination with Evernorth, continuing the trend of XRP-linked corporate structures attracting outsized retail attention. The move is largely reflexive momentum rather than any underlying treasury update. coindesk

SEC greenlights 3x leveraged Bitcoin and Ethereum products. Six Volatility Shares funds offering triple daily exposure to BTC, ETH, gold, silver, oil, and natural gas have been approved to list on Cboe. The approval extends the leveraged-ETP toolkit for US investors who have been watching European and Canadian equivalents for years. decrypt coindesk

Ethereum staking queue stretches past two weeks as validator demand spikes. Nearly 1.5 million ETH is queued for activation, pushing the wait time for new stakers past 25 days. The backlog reflects renewed confidence in ETH yields ahead of the Glamsterdam upgrade, though it also means capital is locked in limbo for new entrants. coindesk

OKX and ICE file for 24/7 tokenised US stock trading under the SEC’s innovation exemption. The OKXICE joint venture has notified the SEC of its intent to launch a tokenised securities venue listing more than 60 names including Nvidia, Tesla, and SpaceX, paired with stablecoins. The filing uses the innovation exemption rather than a full exchange registration, meaning it operates in a sandboxed regime while the ruleset catches up. This mirrors Binance’s simultaneous move to enable 1:1 conversion between listed stocks and its bStock equivalents. coindesk theblock decrypt

Solana Foundation launches an open-source DvP settlement programme built with JPMorgan input. The delivery-versus-payment programme allows institutions to settle trades atomically on Solana with finality in seconds rather than the T+1 or T+2 timelines of traditional rails. JPMorgan contributed to the design spec, which is a meaningful signal that the bank’s digital-assets division is now actively shaping public-chain infrastructure rather than just observing it. coindesk decrypt cryptobriefing

Strategy, Strive, Metaplanet, and Bitmine all report significant treasury activity. Strategy’s BTC stack reached 848,000 BTC after a $28.7 million buy, with a $21 billion Q3 fair-value gain. Strive made its largest purchase since June, adding 2,000 BTC for roughly $169 million and closing in on MARA’s position. Metaplanet sold 10,000 BTC and bought back 11,000 in the same quarter to demonstrate liquidity to rating agencies, while Bitmine crossed 6 million ETH, reaching 99% of its stated 5%-of-supply target. theblock decrypt theblock decrypt theblock decrypt decrypt theblock

S&P Global launches a risk-assessment framework for the $10 billion crypto lending-vault sector. The ratings giant will evaluate digital-asset lending vaults across six risk categories as institutional deposits in the space approach $10 billion. Having S&P publish structured assessments is a prerequisite for many allocators whose mandates require rated instruments, so the framework could unlock a new tier of capital. cointelegraph_defi

ZachXBT spent $350K posing as a client of Lazarus Group’s Chinese launderers. The on-chain investigator says he fronted nearly $350,000 and absorbed a 5% haircut per order to track in real time how Lazarus was moving Bybit loot through a Chinese crime syndicate. The operation produced granular routing data on the laundering network. decrypt

Treasury sanctions expose crypto’s role in a $2 million Hamas fundraising network. A new OFAC action detailed how a Hamas-linked network used digital assets across multiple wallets to raise roughly $2 million. The enforcement action follows a pattern of Treasury using crypto’s transparency against sanctioned actors. coindesk

CFTC proposes a federal framework for leveraged retail crypto trading. Chair Michael Selig introduced Regulation CTX and CAM, which would create a new federal licence category for crypto exchanges whose trigger for oversight is the offering of leveraged or margined products. The CLARITY Act stalled in the Senate, and the CFTC is now using existing statutory authority to fill at least part of the gap. A spot-market exemption remains unaddressed. theblock cointelegraph_regulation decrypt

Fairshake PAC backs 32 House incumbents ahead of the midterms. The crypto industry’s main campaign vehicle is committing funds to House candidates who backed the CLARITY Act, with the list covering a broad partisan mix. The Senate remains the legislative chokepoint, and Fairshake’s House spending does nothing to resolve the stalemate there. coindesk cointelegraph_regulation cryptobriefing

Modern Treasury applies for a national trust bank charter to custody stablecoins. The payments infrastructure firm is seeking OCC approval to operate as a limited-purpose national trust bank, which would let it offer stablecoin custody and related fiat services without a full banking licence. The move arrives as a banking-industry group challenges the OCC’s willingness to grant such charters to crypto-adjacent companies. cointelegraph_regulation

Last sip. The CLARITY Act sits in Senate limbo while regulators on both sides of the aisle write their own rules around it, and nobody has said yet whose framework survives if the bill ever does pass.
