SEC Moves to Fill the CLARITY Vacuum With Its Own Rulemaking

What happened. With the CLARITY Act punted to September and facing a 36-session window before year-end, the SEC has scheduled an open meeting this Friday to consider advancing its Regulation Crypto proposal. Bloomberg reports the agency is preparing at least two significant initiatives, with TD Cowen flagging a token safe harbour as the likely centrepiece.
Why it matters. If Congress cannot hand crypto a statutory framework, the SEC will write one administratively, which is faster but far more reversible. A token safe harbour would let projects distribute tokens without full securities registration, a meaningful unlock for US-based builders who have been routing around the problem via offshore structures. The Fear and Greed Index sits at 27, meaning the market is not pricing any of this as a catalyst yet.
Watch. Administrative rulemaking is easier to challenge in court and easier for a future administration to unwind than statute. Friday’s meeting output will determine whether this is a genuine on-ramp or a holding pattern dressed up as progress. Watch for the scope of the safe harbour definition, specifically whether liquid secondary market trading is included or carved out.
